Pool Compliance with ADA Rules

Does your pool have to comply with the Americans with Disabilities Act's new rules for public accomodations?  The answer may surprise you. 

If your pool is open to the public (not just residents and their guests), you may have to comply.

Department of Justice Issues Revised ADA Regulations on Pool Accessibility

 

On September 15, 2010, the Department of Justice published revised regulations for Title II and Title III of the Americans with Disabilities Act.  Title II covers state and local government facilities and services.  Title III, which addresses public accommodations and commercial facilities, has limited applicability in the apartment context, but does include a new accessibility standard for swimming pools that are open to the public.  This guidance document crafted by NMHC staff reviews the revised regulations and their applicability to the apartment industry.
